1. Acceptance of Terms
By placing an order through the Mario's Pizza online ordering website (the "Site"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site or place an order. These Terms apply to all visitors, customers, and users of the Site.
2. Orders & Pricing
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at any time, including after an order has been confirmed or charged. Prices are shown in U.S. dollars and are subject to change without notice. Applicable sales tax and any disclosed delivery fees are added to your order at checkout. We make every effort to display accurate pricing and product information; in the event of an error, we reserve the right to correct it and notify you before fulfilling the order.
3. Payment & Credit Card Authorization
By submitting an order with a credit or debit card, you authorize Mario's Pizza to charge the card you provide for the full amount of your order, including subtotal, tax, delivery fees, tip, and any applicable card-processing fees displayed at checkout. You confirm that you are the authorized owner or an authorized user of the card and that the card information you enter is accurate and complete.
For orders marked "Pay at Pickup" or "Pay at Delivery," you authorize Mario's Pizza to charge the card on file for the full order amount if the order is not paid for at the time of pickup or delivery, or if the order is accepted and not cancelled within a reasonable timeframe. You also authorize Mario's Pizza to charge the same card for any additional amounts you approve (for example, added items, tips, or shortage corrections) and to process refunds or voids back to the original card when applicable.
Card payments are processed securely through our payment processor. We do not store full card numbers on our servers. A card-processing fee may apply to online card payments and will be disclosed before you confirm your order.
4. Delivery & Pickup
Delivery orders are fulfilled only to addresses within our delivery area. Estimated delivery times are approximate and not guaranteed. Mario's Pizza is not liable for delays caused by traffic, weather, incomplete address information, or circumstances beyond our control. For delivery orders, please provide a valid address and a reachable phone number so our driver can contact you.
Pickup orders should be collected during business hours. Orders not picked up within a reasonable time may be discarded, and charges may still apply.
5. Cancellations & Refunds
Orders can be cancelled for a full refund if cancelled before preparation begins. Once an order has been started or completed, cancellations and refunds are at the discretion of Mario's Pizza. If you are charged in error or receive an incorrect order, please contact us promptly and we will make it right. Approved refunds are returned to the original payment method and may take several business days to appear on your statement.
6. Allergens & Food Preparation
Our kitchen handles common allergens including wheat, dairy, eggs, soy, nuts, and others. While we take care to avoid cross-contact, we cannot guarantee that any item is completely free of a particular allergen. Customers with food allergies or sensitivities should contact the store directly before placing an order.
7. Loyalty Program
Loyalty points and rewards have no cash value and are non-transferable. Mario's Pizza reserves the right to modify, suspend, or terminate the loyalty program at any time. Points may be revoked if earned through fraud, system error, or abuse of the program.
8. Limitation of Liability
To the fullest extent permitted by law, Mario's Pizza and its owners, employees, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any order placed through it. Our total liability for any claim related to an order is limited to the amount you paid for that order.
9. Privacy
We collect and use your name, contact information, and order history solely to fulfill orders, provide customer support, and improve our service. We do not sell your personal information. Payment card data is handled by our certified payment processor and is not stored on our servers.
10. Changes to These Terms
Mario's Pizza may update these Terms at any time. The most current version will always be posted on this page with the updated date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
